1. General
1.1. These Terms of Service (“Terms”) govern use of the Opsy product (commercially referred to as “Opsy by IT Group”), the website https://deostech.kz (including /platform and related APIs), and related materials, between IT Group, acting as the service Operator, and the User.
1.2. By using the Website or Opsy, the User confirms that they have read these Terms and our Privacy Policy and agree to them.
1.3. If the User does not agree, they must stop using the Website and services.
2. Definitions
2.1. “Website” means web pages under deostech.kz. “Service” means Opsy software and infrastructure for Kubernetes-related deployment workflows. “Account” means credentials and data identifying the User for access to the Service.
3. Subject matter
3.1. The Operator grants the User a right to use the Service within the selected plan or trial, as described on the Website.
3.2. Functionality may change; the Operator may perform maintenance that temporarily limits availability.
4. Registration, API keys, and security
4.1. Use of the Service may require registration or API keys. The User must provide accurate information and protect secrets.
4.2. The User is responsible for all activity under their credentials. Suspected unauthorized use must be reported promptly to info@deostech.kz.
5. Acceptable use
5.1. The User must not violate applicable law (including the Republic of Kazakhstan and the User’s jurisdiction), infringe third-party rights, or:
- interfere with or attack the Service, impose unreasonable load without agreement;
- use the Service for malware distribution, spam, or illegal content;
- circumvent technical, licensing, or security controls.
5.2. The Operator may restrict, suspend, or terminate access for violations where reasonable.
6. Intellectual property
6.1. The Service, Website, trademarks, UI, documentation, and related materials are owned by IT Group (the Operator) and/or licensors.
6.2. The User receives a limited, non-exclusive, non-transferable license to use the Service under their agreement. Reverse engineering, unauthorized copying, or decompilation is prohibited except as allowed by mandatory law.
7. Personal data
7.1. Processing of personal data is described in the Privacy Policy.
8. Disclaimer; limitation of liability
8.1. The Service is provided “as is”. The Operator does not warrant uninterrupted or error-free operation or fitness for a particular purpose.
8.2. To the maximum extent permitted by law, the Operator is not liable for indirect damages, lost profits, data loss, or business interruption.
8.3. The User is responsible for backups, rollback procedures, and risk assessment for business-critical use.
9. Changes to the Terms
9.1. The Operator may update these Terms; the new version is published on the Website. Continued use after publication constitutes acceptance unless a different process is stated.
10. Final provisions
10.1. These Terms are governed by the laws of the Republic of Kazakhstan. Disputes shall first be pursued in good faith negotiation; if unresolved, courts in Almaty shall have jurisdiction.
